If you have waited longer than 18 weeks

For many consultant-led referrals in England, the NHS Constitution standard is to start treatment within 18 weeks unless an exception applies. This does not apply in every situation.

Your rights

The 18-week standard is a right under the NHS Constitution for England. If you have waited longer than 18 weeks, you have the right to ask your provider to offer you alternatives, including treatment at another hospital if clinically appropriate.

Steps to consider

1. Ask your GP or hospital to confirm your referral status and the date your 18-week clock started.
2. Ask whether any clinically suitable alternative providers are available — your provider should offer alternatives if the 18-week standard is not met.
3. Contact the provider’s PALS team if you need help with communication or wish to raise a concern.
4. If you make a formal complaint and it is not resolved through the NHS complaints process, you can escalate to the Parliamentary and Health Service Ombudsman (PHSO).
